The bill is very vague and leaves a lot open for deliberation and manipulation by interests.  If we are really trying to curtail a riskful set of uses and set safeguards it should be more specific.  I noted a couple of places where this is the case and where I believe more details are needed. Here are some of the questions that occured to me while reading...

Is it realistic to expect the safeguards to be equivalent for ALL storms? What about  a category 5 hurricane that wipes out everything else in an area? Will there be limits/prohibition for placing such facilities in an area that is essentially a sandbar (the barrier islands).

If you categorically prohibit "(ALL) discharges" I think you beg opposition and do not reflect the reality of what may need to happen to prevent larger problems. Hence my comment on parameters and testing.  Amy

If possible, please change Line 91. If the object is to limit the maximum plant height to 14', the current language is a double negative. There is similar clear language on Lines 204-206.

Please change Line 91 to: 

"not be required to have a mature height not to exceed in excess of 14 feet." MH 4/14/06

The language (lines 6-7) is spongey. I'd prefer simply to state that:  The following regulation is specifically exempted from the provisions of this authority:  a) existing local ordinances that govern planting, pruning, trimming, or removal of specimen trees or historical trees (as same are defined in any such local governmental ordinance or regulation); and b) trees now or hereafter located within canopy protection areas (as same are defined in any such ordinance or regulation). 

Insofar as power lines have standard heights of 20', we feel the 14' height limitation (line 20) is overly restrictive.

Re lines 21-22 -- it is unclear from who or what authority does the bill anticipated recoupment of costs associated with vegetation maintenance?  the local government?  the utility's customers? DM 4/14/06

The County does not support giving up local land use control. The Planning Dept. would not need information relating to a utility's business decisions or customer service practices. However, it may be useful to provide information on the viability, success and customer service relations of a new business/utility being present in the County.

It is important for the Utility Company to prove that additional service is needed in order to construct a substation.

The idea of the Utility company providing alternative locations is reasonable and fair and provides the County and community a variety of options to work with. However, these locations should conform to local land use regulations.

Using the Property Appraiser's database, we have conducted an analysis on the parcel(s) on Phillippi Creek that Jim mentioned might be a good first look at this issue to test Senator Bennett's thesis on the mobile home parcel conversion issue. We also selected another mobile home park as a control to measure year to year increases in value to use as a comparison...

The mobile home park in question on Phillippi Creek, while it was classified as a residential-multifamily-18 units per acre, experienced an average annual increase of 2.5 percent over the period 1999 - 2001, while the County experienced an average 7.74 percent growth rate; the control mobile home park had an average increase of 1.5 percent.

In 2002, the Phillippi mobile home park was sold and reclassified as vacant-commercial-valueless improvement, which resulted in an average increase of 8.3 percent valuation over the next three year period of 2002-2004; the control mobile home park, which retained its classification as a mobile home park during that same time period, grew by an average of 9 percent. So far, as you can see, the valuations are running consistent with one another.

But, in 2004, the Phillippi parcel was sold, and divided into 9 parcels classified as vacant commercial; from 2004 to 2005, the combination of the valuation of all 9 parcels collectively ($18,026,000) out-grew the single 2004 valuation ($5,663,000) by over 200 percent. The control mobile home park valuation, during this same period, grew by 13.73 percent, while the county as a whole grew over 19 percent.

Obviously this is only one conversion we have looked at, but it does lend some validity to Bennett's thesis, that converting will indeed drive property values for the associated parcel(s) at a rate that will indeed benefit the intake of ad valorem...but, conversely, it shows that it isn't instant  - it takes time for the county to reap the benefits of the reclassification and subsequent revenue proceeds, thus resulting in another unfunded mandate that we would have to front until the addition revenue was collected; and this is during a time of prosperous, unprecedented growth in property value; a trend that will not continue into the long-term future. (Jeff Seward; 3.16.05)

The Environmental Permitting bill appears to prevent local governments from adopting or enforcing ordinances or other regulations prohibiting or restricting wetlands mitigation that offsets wetland construction impacts.

>>> "Diana Grawitch" <dgrawitch@fl-counties.com> 3/23/2006 5:57 PM >>>  The majority of the bill applies only to counties in the Northwest Florida Water Management District.  Those of you in this area should review the bill closely if you haven't already done so, as it has a significant impact on wetlands in that area.  However, everyone please see pages 2 and 3, lines 51-58.  This is a statewide county preemption which provides that no local government may adopt or enforce a regulation that prohibits or restricts mitigation that offsets wetland construction impacts.  I need feedback on this as well as technical comments so that FAC can determine how to best proceed with this bill. It was introduced on Wednesday (3-22) in Environmental Regulation.  It will now be given a bill number and referred to its committees. DMZ 3.24.06

The lines 51-58 referred to above,mean that we as local government cannot prohibit someone from mitigating for impacts. As long as the prohibition solely relates to mitigation being allowed then it is consistent with our current program. If the prohibition pertains to regulating the activity then we have a strong issue with this language and oppose it. The prohibition does not seem to limit our ability to condition the terms of mitigation as language later in the bill does within the NWFWMD. ASM 3-29-06
