Sarasota County is currently proposing additional regulations to increase affordable housing. Wendy Thomas is currently reviewing the bills and will better be able to inform you how they would impact Sarasota County with regards to our affordable housing program. I believe several other affordable housing programs and opportunities are just beginning with the Community Housing Trust (Martina Guilfoil, Executive Director).
General Comments: HB 1363 and SB 132:
Sarasota County already tracks and monitors surplus land. This would not be a new initiative. However, it would take additional staff time and resources to identify which lands would be most suitable for development of affordable housing. A 6 month time frame to identify County owned parcels useable for affordable housing and have the BCC be required to "immediately" put them up for sale seems extremely unreasonable. The Counties should be able to release land for sale at their own discretion.
Under 125.379 3 b) of the bill, a private developer could purchase these without any affordable housing required. The a) provision requires 20% for owner occupied or 25% for renter the c) provision is for Non Profits.
Comments on program priorities & incentives:
Reduction of impact fees: may be a possible incentive (similar to the Enterprise Zone). However, funding for infrastructure improvements will still need to be in place, planned for and budgeted.
Reduction of traffic concurrency requirements up to 25 % - if traffic concurrency requirements are reduced what can we do to increase public transportation?
Support any additional funding for existing programs. JLR 4/21/06
Section 1, Inventory: we are already doing this and have given comments to Marsha, the bill was amended to address our comments.
Section 3: Do not support this provision. This would allow mobile home developments with treatment plants and access to water anywhere outside the USB. This would undermine the policies that support having a USB and also 2050. No transportation concurrency requirements where a development could have hundreds and hundreds of homes seems to undermine the principles of growth management and smart growth. Placing an intense development in the middle of a rural area with no access to infrastructure and no requirement for the provision of infrastructure would be disastrous.
Section 7, strongly support from an AH perspective. Need to know the fiscal impact of decreasing tax base for non-homesteaded property.
Section 8, homestead deferral?unsure of fiscal impact, bill summary unsure also.
Section 9 & 11, this is regarding FL Forever/Preservation 2000, should resource Protection look at these provisions?
Section 17, ask Don to comment on impact of the change of the definition. It appears this won?t have an impact on our programs, but Don would know best.
Section 19, strongly support. Keeping this provision in the bill is key!
Section 23, the bill has a sun set date of 2009. With the program in effect for only 3 years, I?m not sure how effective it will be in bring AH opportunities to Sarasota County. We have few not for profits who have the capacity to utilize the program. Reduction or waiver of impact fees will have a fiscal impact. Most of the incentives we are in the process of putting into effect based on EAR Amendments. Requires community to have a community workforce housing strategy in place. Where is the funding for the program coming from?
Section 44, allows mobile home parks in all land use categories except preservation or conservation. Do not support! See comments on Section 3. WT 4/24/06 |

This bill would increase the rights of sign owners and also would force local governmental entities to pay fines to these sign owners if and when they do not comply with the new "view zones" and increases in sign heights. This bill still allows local governmental entities to enact local ordinances regulating outdoor advertising, however, these regulations must be in harmony with the state and federal requirements.
There is a potential negative fiscal impact to the county, however, because Sarasota County is not currently adding noise barriers or beautification to our local highways there are no grounds for billboard owners in our area to dispute any "view zones." SB 3-28-06 |

The bill will be heard next in the Local Government Council, and the council chair and vice chair (Representatives Sorenson and Robaina) have asked that we draft amendments that are similar to the cell tower siting legislation that passed last year. This bill is not expected to effect the current tax revenues and only reallocates the total of $12 million which is currently in place. As noted in the Senate Staff Analysis this bill will likely have an adverse but indeterminate impact on the number of low income homes that are built each year since the $9.6 million will be reduced to $8 million. On the flip side, this is expected to have a positive but indeterminate impact on projects which are sponsored in the Enterprise Zones and Front porch Florida Communities since their $2.6 million will be raised to $4 million. What it does for us is allow flexibility of surtax proceeds useage, including the paying down of our millage (which we wouldn't do, most likely, since ours is so low) and use for operating; although agreeing to do either of those two issues locks us into subsequent years of a 3% growth rate over our rollback rate (but the recommended amendment by FAC eliminates that requirement). Impact to SC Gov - Core Service Delivery This bill is very different than HB 1199, which FAC has been fighting in the House. It retains local governments as the franchising authority. Local governments must enact an enabling ordinance by Jan. 1, 2011, setting forth the government's requirements for the typical items included in a franchise agreement including: PEG access channels, in-kind support, customer service, build out, use of rights of way, etc.. The cable provider would then operate pursuant to such requirements. Several jurisdictions have adopted this scheme currently (Miami Dade County, Broward County) and it works well. By retaining authority pursuant to an ordinance, the local government would still have teeth to enforce its requirements. This is a much better approach than HB 1199 proposes, which eliminates local governments totally from cable regulation.
The Florida League of Cities and Association of Counties are hoping and expecting many local government officials to testify at Tuesday's hearing in Tallahassee. Of course, the cable and telephone industries will testify (telephone companies and their supporters will testify against this proposal since it retains local authority). Impact to SC Gov - Core Service Delivery Public Works(1) - 4/11/2006 2:20:46 PMPending With respect to transportation, the general provisions of the Sarasota County Concurrency Management Regulations are more restrictive than 2005 statutes. The general provisions have remained relatively unchanged since adoption in 1989. The statutes allow for a variety of exceptions and we have applied a few of those. However, the general rules for what may be considered available capacity are as follows:
1) State. Needed transportation facilities must be in place within three years of the issuance of building permit which according to Rule 9J-5 allows consideration of road projects that are: - existing - under construction - fully funded in the first three years of the local capital program or the State work program.
2) County. Needed transportation facilities must be in place within one year of final development order, which is typically the construction authorization but a building permit is also a FDO. According to regulations, the County considers the following as available capacity: - existing - under construction - fully funded in the budget year of the County's CIP. CD 4.11.06

The Sarasota County Division of Urban Forestry opposes this bill, as unnecessarily excessive, unpredictably broad and susceptible to negative economic impacts. Of the four trees currently promoted by utilities as preferred in Central Florida, two are unavailable and, in any event, do not grow in our County. A third is actually considered a bush. The bill essentially creates in the utility potential power to establish innumerable treeless corridors. Further, coupled with HB 0273/SB 0566, the effect would be potentially devastating.
Our concerns are consistent with BOCC's mandate, issued in January 2005, to develop and maintain a community forest pursuant to standards set by American Forest.
If applied as written, this bill poses a number of potential, adverse economic impacts. Urban forests sequester carbon and other greenhouse gas precusors and particulate pollution, intercept rainfall and moderate/filter surface water runoff, and reduce energy consumption. In 2003, the County's Urban Ecosystem Analysis estimated the value of its urban forest at nearly $8 million, calculating only for carbon sequestration and energy savings values. NOTE, HOWEVER, that a barrel of crude oil sold during this time for less than $30.00/barrel, and it is likely that those 2 values alone would exceed $12 million in today's market. Chapter One of Sarasota County's developing Urban Forestry Management Plan is added below as a file, and contains a detailed analysis of tree benefits and their quantification. In brief, an urban forest economically performs essential functions in a manner that would be prohibitively expensive to duplicate with built infrastructure.
We are in favor of a cooperative program that recognizes the significant economic, environmental and social benefits of a healthy urban forest and canopy, and seeks to promote those benefits while securing access and reliability of utility service. A number of alternatives exist, and are implemented in other regions and countries, which promote both healthy urban forests and power service. D.J. The amended language directly pertains to the permitting of wet and dry storage boat facilities. The proposed language does not reference or recognize Manatee Protection Plans. Sarasota County has adopted a Manatee Protection Plan that has been approved by the Florida Fish and Wildlife Conservation Commission. The Plan contains a Boat Facility Siting Plan and contains specific regulations pertaining the development of wet and dry storage boat facilities. We recommend adding language that recognizes existing Manatee Protection Plans and that wet and dry storage boat facilities shall be consistent with existing Plans. In addition, these types of facilities should not be exempt from the DRI process unless a Manatee Protection Plan has been approved for that specific jurisdiction. (ASM - MO 4.3.06)

It appears the main goal of the proposed language is to make it easier for developers to qualify for exceptions under DRI requirements. The language also adds statutory exemptions, doubles exemption limits, increases developer's time frames - decreases staff's time. We need to make sure that our local regulations, including but not limited to, Manatee Protection Plan regs, Land Development Review regs, and the Water & Navigation Control Authority regs, are not limited or prevented. These ISBAs can address: service delivery, fiscal responsibility and boundary alignment.

Customer service standards would also be enforced by the state and the counties and municipalities will lose their franchising authority. This bill goes against the Florida Association of Counties policy statement and also goes against the Florida Leauge of Cities position to support municipal authority. The fiscal impact, if any, to Sarasota County may vary depending on how the State would award franchises in our area differently than we would have if we still maintained control. Also, the county would lose any monies collected from ROW uses.

Impact to SC Gov - Core Service Delivery Administration and Finance(1) - 4/24/2006 1:34:07 PMComplete As stated in the JLR analysis this is not an entirely new concept. Sarasota County has been working on addressing the Affordable Housing issue and this Bill would simply place timelines on how the County will handle this. This Bill will try to stimulate local governments to support these efforts but does not require any set level of financial participation. The bill also increases the amount of Community Contribution Tax Credits from $12 million to $13 million. This may lead to increased revenues to projects in Enterprise Zones and Front Porch Florida Communities. It is also interesting to point out that in the last 4 fiscal years the entire $12 million in Community Contribution Tax Credits have been approved so this should be a strong indicator that the increase in the $1 million dollar cap should indeed filter back to these local programs and stimulate the growth in low income homes. There will be a cost to the county where we will have to spend time and money administering this program and making sure we follow the criteria set there-in.
Appropriations summary:
$33 million for housing to extremely low income persons $50 million to implement community workforce housing innovation program $82.9 million for affordable housing hurricane recovery $176 million for the rental recovery loan program $400k for technical and training assistance $25 million for farm worker housing recovery $15 million for entities working with the affordable housing recover from the 04-05 hurricanes $2 million in fixed capital outlay for the disaster recovery assistance program
Lastly, this fiscal impact to Sarasota County is indeterminate. Any cost to the county in how we work on the affordable housing issue within this bill may ultimately be offset by the increase in our workforce if these homes are built. More residents earning wages and pumping new dollars into our local economy could ultimately lead to a positive fiscal impact to our economy but not knowing any specifics as to how many homes, what land, etc. leaves this analysis to be fiscally indeterminate. Planning and Community Development(1) - 4/24/2006 8:29:48 AMComplete Sarasota County is currently proposing additional regulations to increase affordable housing. Wendy Thomas is currently reviewing the bills and will better be able to inform you how they would impact Sarasota County with regards to our affordable housing program. I believe several other affordable housing programs and opportunities are just beginning with the Community Housing Trust (Martina Guilfoil, Executive Director).
General Comments: HB 1363 and SB 132:
Sarasota County already tracks and monitors surplus land. This would not be a new initiative. However, it would take additional staff time and resources to identify which lands would be most suitable for development of affordable housing. A 6 month time frame to identify County owned parcels useable for affordable housing and have the BCC be required to "immediately" put them up for sale seems extremely unreasonable. The Counties should be able to release land for sale at their own discretion.
Under 125.379 3 b) of the bill, a private developer could purchase these without any affordable housing required. The a) provision requires 20% for owner occupied or 25% for renter the c) provision is for Non Profits.
Comments on program priorities & incentives:
Reduction of impact fees: may be a possible incentive (similar to the Enterprise Zone). However, funding for infrastructure improvements will still need to be in place, planned for and budgeted.
Reduction of traffic concurrency requirements up to 25 % - if traffic concurrency requirements are reduced what can we do to increase public transportation?
Support any additional funding for existing programs. JLR 4/21/06
Income limit under this bill is 150% of AMI in 132 it is 140%. Either bill, but particularly 1363 is a huge housing subsidy for middle class critical community workers.
Sarasota should qualify as high cost, but with leveling off of school enrollment may no qualify as high growth community.
Again there is a provision that allows for reducing or waiver of fee payment or impact fees. Fiscal impact?
Modify or reduce traffic concurrency requirements by up to 25%. Impact?
Sale price restrictions will make condos a difficult product to develop given the higher median sale price for condos than for SFD or TH units.
Defines skilled building trades personnel as essential service personnel.
Manny Diaz Tax Relief, this provision should apply to homes where resale equity is limited also, but fully support provisions regarding rental tax relief. As with 132 fiscal impact?
Will provision for Ad Valorem Tax relief apply to LIHTC properties also?
Density incentives for Land Donation: Matt Lewis should look at this provision to see how it would affect 2050. I believe if Rod donated his 17th street property to CHT for AH, he could transfer density to Hamlet so long as the density did not exceed 6 du/ac, subject to local gov?t approval. This is the bill that the Florida Energy Office and Governor is supporting this year instead of the Hydrogen Technology Act that failed to get out last year. The funding for hydrogen initiatives is back in this bill, along with some other really great renewable energy, energy efficiency, biodiesel incentive provisions that could be beneficial for both local governments and the public. The utility siting pieces to this don't appear troublesome to me, but I am not the land use authority. We have discussed distributed generation as a potential strategy for the Fruitville Road Corridor project. The county could potentially become a small power generator (utility) if we work that out for Fruitville. Under HB 1473, Section 403.50665 Land use consistency determination- new language appears to say that if a utility files to site a new power plant, local government, after determining that it conforms to existing land use and zoning, cannot thereafter change land use or zoning to prohibit construction or operation of the power plant. Once again I defer to Planning staff for their analysis of the land use sections of this bill. NPOW-3/20/06

I wanted to provide a quick update on the conference call this morning with the FAC Legislative Executive Committee. Basically, the committee authorized FAC staff to engage the bill sponsors and the League in working towards a mutual solution. However, they outlined some clear parameters for negotiations. The critical parameters include a) limiting any legislation to charter county provisions (which exempts ordinances, land development regulations, and the non-charter counties); b) requiring any municipally-driven change to a future charter provision to undergo a countywide referendum; and c) "grandfathering" the existing 19 charter counties.
Since the conference call, I received a call-back from the League and expect to meet with them soon (likely tomorrow). I'll keep everyone posted on our progress.

AF: This bill, as also does HB 949, retroactively erodes Charter County powers. It is a preemption of general laws previously enacted by the Legislature. The State Constitution grants Charter Counties the power to determine, in the County Charter, which ordinances prevail in the event of conflict between county and municipal ordinances. (Can the Legislature, by general law overturn the power of Charter Counties to determine which ordinances prevail, as granted them by the State Constitution?)
The bill exempts transportation and school countywide impact fees but, does not do so for Sarasota?s library impact fee.

MRP: This is a bill proposed by Sarasota County, although the language of the bill was changed from what was drafted by Assistant County Attorney Elizabeth Woodford. We obviously support legislation to limit fees paid to expert witnesses, although as it was introduced, we are opposed to the wording.
As it is currently worded, a guaranteed $5,000 would be paid to expert witnesses, without regard to the amount of compensation offered.
On every road project, and most sidewalk projects, a Temporary Construction Easement is obtained for the purpose of reconstructing driveways. These are normally less than $1,000 in value. Currently, we have over 500 parcels we are working to acquire, all at less than $1,000 value. If this bill were to be passed, there would be a potential $2.5 Million impact if these were to go to an eminent domain case.
We support changing the text of this bill back to our original form, amending 73.091(1) to add a sentence at the end reading: "In no event shall the total of expert fees awarded exceed 20% of the first $250,000 of the amount of compensation awarded or agreed upon plus 5% of the amount over $250,000, or $5,000, whichever is greater." The federal government and many states do not pay for the owner's attorney fees and expert fees,however,in Florida the state pays for the property owner's attorney and expert fees during an eminent domain proceeding and this bill would limit those fees to:
Awarded Compensation < $250,000 = No less than $5,000 or no more than 20%.
Awarded Compensation > $250,000 = May not exceed $50,000 plus 25% of the amount which exceeds $50,000.
Ultimately this bill would/could save the state government money in fee payments during an eminent domain proceeding.

The lines 51-58 referred to above,mean that we as local government cannot prohibit someone from mitigating for impacts. As long as the prohibition solely relates to mitigation being allowed then it is consistent with our current program. If the prohibition pertains to regulating the activity then we have a strong issue with this language and oppose it. The prohibition does not seem to limit our ability to condition the terms of mitigation as language later in the bill does within the NWFWMD. ASM 3-29-06

I have been soliciting comments on HB 7175 by the Committee on Environmental Preservation and Rep. Needelman regarding derelict vessels and public access to waterways. I've had extensive comment on this from other counties, but I don't think I've heard from Sarasota. The bill provides several new sources of funding for derelict vessel removal and public access to waterways. However, it also contains a provision that expands a state-level exemption from permitting for floating vessel platforms (commonly referred to as floating docks) to include docks that are attached to bulkheads. This was a big concern for some of our counties, so we have worked with the sponsor on an amendment (please see attached) that narrows the scope of local preemption so that it is not a total preemption. Our counties are all over the place on this. One county has indicated a willingness to support the bill even with this provision in it. Several counties have indicated that they would prefer we remain neutral on the bill. And one county has indicated a strong opposition to the bill as long as it contains any provision limiting local government authority relating to bulkheads. FAC's current strategy is to remain neutral on the bill, which is up on Wednesday morning in the State Resources Council. We want to thank Rep. Needelman for recognizing the need for funding, and to strongly support additional funding for derelict vessel removal and public access to waterways. We will also recognize that the bulkhead language is much-improved, but will make it clear that we oppose even a partial local government preemption, and we'll pledge to continue to work with the sponsor on this. I have spoken with the sponsor at length, so he is aware that this will be our position.
